Vehicle Storage Terms and Conditions



TERMS & CONDITIONS OF AGREEMENT

1. Subject to payment of the Monthly Fee, Create Storage Ltd. accepts temporary custody of the Vehicle for the Storage Period.

2. The Owner of the Vehicle parts temporarily with the Vehicle for the Storage Period and agrees to pay the Monthly Fee.

3. The Vehicle must be insured and kept insured during the Storage Period. Current insurance cover to be verified at inception and each subsequent renewal of storage.

4. The Vehicle must be secured as per the conditions of the insurance policy in respect of the stored Vehicle.

 A spare set of keys must be lodged with Create Storage Ltd. to facilitate movement as they see fit. Create Storage Ltd. will undertake to store said keys in a safe and secure manner.

5. All personal effects and valuables must be removed from the Vehicle, and the windows and door(s) to remain locked during the period on site. Any items left in the Vehicle are left at the owner’s risk. The owner is reminded that many insurance policies may not cover possessions in the vehicle.

6. By entering into this agreement, the Owner warrants that he/she has both ownership and legal title to the Vehicle.

7. In order to comply with The Regulatory Reform (Fire Safety) Order 2005 all gas bottles are to be switched off or removed when the Vehicle is on site. No other noxious, hazardous or explosive substances or preparations are allowed on site.

8. Access to the site is per the Access Hours, access at any other time by prior arrangement with Create Storage Ltd. Notice must be given prior to collection of the Vehicle.

9. Please be aware that all entry and exit movements may be logged and that the storage facility is covered by CCTV, all of which is recorded and stored.

10. The Vehicle is to be parked correctly within the allocated plot, or left secure in the collection/delivery area. 

11. The Vehicle and the allocated plot area must be kept tidy and no litter left behind.

12. Storage spaces are not transferrable to third parties.

13. The agreement does not permit the stationing of an alternative or replacement vehicle. However, a car may be left in place of a motorhome but only with the prior knowledge and consent of Create Storage Ltd.

14. Vehicles should be kept clean, mechanically sound, and in good condition.

15. No trading is permitted from the site, and the Vehicle must not be offered or advertised for sale while on site.

16. The Vehicle must not be inhabited within the storage area during the Storage Period.

17. No major repairs to the Vehicle to be carried out on site (minor repairs may be carried out with the permission of Create Storage Ltd.).

18. The Rental is payable in accordance with the Payment Terms, Create Storage Ltd. has the right to alter the Monthly Storage Fee by giving notice to the Owner in accordance with clause 19.

19. Create Storage Ltd. reserves the right to increase the Monthly Storage Fee and shall give the Owner not less than one month notice of an increase following which the new value shall be the Monthly Storage Fee.

20. Either the Owner or Create Storage Ltd. may terminate this agreement by giving not less than fifteen days written notice to the other and termination will take effect from this, the due date.

21. In the event of the Monthly Storage Fee being overdue Create Storage Ltd. may retain possession (lien) of the Vehicle until the arrears are settled in full or otherwise discharged. Create Storage Ltd. undertakes to notify possession by recorded delivery.

If You do not pay Our Fees on the Due Date, You must pay us an administrative charge for late payment which is the larger of 10 per cent of Our Fees or £5.

Additionally, on each occasion any cheque is dishonoured, at our option You must pay us an administrative charge of £12.

22. In the event of a negative response to possession, legal action may be taken to sell the Vehicle via The Torts Interference with Goods Act 1977. The outstanding arrears will be deducted from the proceeds of the sale, as will any reasonable costs Create Storage Ltd. have incurred. The remaining balance will be retained to await collection. Create Storage Ltd. will seek to obtain the best price available based on current market values, and notify the Owner of the date and place of sale.

23. Create Storage Ltd. excludes all liability caused by Vermin Infestation, a recognised vermin control regime is in place and is monitored regularly.

24. In the performance of this agreement Create Storage Ltd. will at all times act with due diligence in providing a fit and proper place for the storage of the Vehicle.

25. Staff are not held liable for any damage to the Vehicle or its contents as a result of towing or the movement of the Vehicle unless due to the proven negligence of staff. 

26. Should the Owner damage a third party’s Vehicle or property then he/she is required to report the matter immediately to Create Storage Ltd.

27. Periodic checks may be made on the identity of all Vehicles stored on the site.

28. Create Storage Ltd. reserves the right to refuse any Vehicle not deemed acceptable.

29. Create Storage Ltd. reserves the right to ask the Owner to remove their Vehicle from the site if they do not abide by these terms and conditions.

30. No unauthorised access is allowed to any person other than the Owner of the Vehicle stored in the compound or those persons named on the agreement. Owner identification will be required.

31. Create Storage Ltd. excludes all liability for loss or damage where the means employed are in excess of the duty of due diligence.

32. Where it appears that a Vehicle has been brought onto the storage site for the purpose of abandoning it, Create Storage Ltd. may arrange disposal of the Vehicle via the provisions of Refuse Disposal (Amenity) Act 1978 as amended and any costs incurred will be recovered from the person who brought the Vehicle onto the storage site.

33. Should the Vehicle be damaged whilst on site the Owner is requested to immediately inform Create Storage Ltd. In cases where the Owner considers that they have a claim against Create Storage Ltd. then he/she is required to provide written details to Create Storage Ltd. within 72 hours of the Owner becoming aware of the claim.

34. Any changes to the details provided by the Owner in this agreement to be notified to Create Storage Ltd. without undue delay.

35. Whilst Create Storage Ltd. does their utmost to provide security for the Vehicle stored with them, it is impossible to completely eliminate the risk of theft or damage and as such will not be held liable.
